Vaping in Australia (We do not encourage anyone to bypass Australian vaping regulations.)
Vaping in Australia has changed significantly in recent years. The country has not simply introduced a blanket ban on every form of vaping. Instead, Australia has established a highly regulated framework governing the importation, supply, possession, advertising and use of vaping products.
Understanding these rules is important for everyone involved—from adult consumers and patients to pharmacies, suppliers and retailers.
The purpose of the current framework is to ensure that therapeutic vaping products are supplied through appropriate channels and primarily used for smoking cessation or the management of nicotine dependence.
Is Vaping Completely Banned in Australia?
No. It is more accurate to say that vaping is heavily regulated in Australia.
The major change is how vaping products can legally be supplied.
Under the current national framework, therapeutic vapes can only be supplied through pharmacies for therapeutic purposes. Non-pharmacy retailers such as tobacconists, convenience stores and vape shops cannot legally supply vaping products.
This distinction is important because saying simply that “vaping is banned” does not accurately describe the current regulatory system.
There are lawful pathways for eligible patients to access therapeutic vaping products through participating pharmacies.
Who Can Access Therapeutic Vapes?
Access depends on factors including age, nicotine concentration, clinical circumstances and the laws applying in the relevant state or territory.
For adults aged 18 and over, participating pharmacies may supply certain therapeutic vapes containing 20 mg/mL or less of nicotine without a prescription, provided the pharmacist completes the required consultation and other conditions are satisfied.
A prescription may still be required in particular circumstances, including for higher nicotine concentrations or where state or territory requirements require one.
People under 18 are subject to additional restrictions and, where permitted by state or territory law, require a prescription.
Pharmacy Supply Is Different From Ordinary Retail Sales
This is one of the most important points for Australian customers to understand.
The current system does not allow an ordinary vape shop or tobacconist to operate as a normal retail outlet for vaping products.
The TGA states that vapes cannot be supplied through non-pharmacy retail stores, including vape shops, tobacconists and convenience stores.
Therapeutic vaping products must instead be supplied through the appropriate pharmacy pathways and must meet the applicable regulatory requirements.
That means customers should be careful when purchasing online or from businesses that appear to operate outside the Australian pharmacy framework.
Vaping Products Are Regulated, Not Simply Unrestricted
The current Australian framework covers much more than nicotine.
The national regulatory framework applies to vaping devices, vaping substances and vaping accessories. It also covers importation, domestic manufacture, commercial possession, supply and advertising.
This is why responsible businesses need to understand the rules rather than treating vaping products like ordinary consumer goods.
Compliance matters at every stage of the supply chain.
What About Prescriptions?
A prescription is required in certain circumstances.
For example, therapeutic vapes containing more than 20 mg/mL nicotine require a prescription, and additional prescription requirements can apply depending on the patient's circumstances and state or territory law.
Customers should not assume that having a prescription automatically means that any vape product can be purchased from any retailer.
The product, supplier, pharmacy and applicable regulatory pathway all matter.
Customers Should Understand Their Responsibilities
Anyone using a vaping product should understand that the responsibility does not end when the product is purchased.
Customers should follow applicable laws, use products only as permitted, and avoid using or carrying vaping products in places where vaping is prohibited.
If you are travelling, attending workplaces, entering public buildings, visiting venues or moving through restricted areas, check the applicable rules before using a vape.
A supplier cannot determine where an individual customer chooses to use a product after purchase.
The customer remains responsible for complying with the laws and rules that apply to their own conduct.
Be Careful About Where You Vape
Restrictions on vaping can vary depending on the location and applicable state or territory rules.
For this reason, customers should never assume that because vaping is permitted somewhere, it is permitted everywhere.
If you are unsure, check the relevant local rules before vaping.
This is particularly important around workplaces, public buildings, transport areas, hospitality venues, schools and other restricted locations.
Responsible Vaping Starts With Knowing the Rules
A responsible customer should understand more than just the product's flavour or puff capacity.
Before purchasing or using a therapeutic vaping product, consider:
- Whether you meet the applicable age requirements
- Whether a prescription is required
- Whether the product can lawfully be supplied through the relevant pathway
- Whether the product meets applicable Australian requirements
- Where vaping is legally permitted
- Whether the product is being used for its lawful therapeutic purpose
These considerations are just as important as choosing the right product.
Why Buying From the Right Source Matters
Australia's current vaping framework places significant responsibility on the lawful supply chain.
The TGA warns that unlawful importation, manufacture, supply and commercial possession can result in serious consequences, including seizure of products and significant penalties.
Customers should therefore be cautious about websites or sellers making claims such as “no prescription required,” “Australian vape shop delivery,” or “guaranteed unrestricted supply.”
If a seller's business model appears inconsistent with Australian law, customers should investigate before placing an order.
What About Delivery?
Delivery arrangements must also comply with the legal requirements applying to the products and the supplier.
A parcel arriving at your door does not make an otherwise unlawful supply lawful.
For legitimate pharmacy-based supply, customers should follow the pharmacy's approved ordering and delivery procedures and provide whatever information or documentation is required.
Where a pharmacy offers delivery, the customer should confirm the delivery arrangements directly with the pharmacy.
Discreet Packaging
Privacy can be important to customers purchasing health-related products.
Where lawful delivery is available, appropriate packaging can help protect customer privacy during transportation.
However, discreet packaging should never be confused with an attempt to conceal an unlawful product or supply chain.
The priority should always be legal compliance, product safety and responsible handling.
What About Larger Orders?
Large or bulk orders require particular care.
Commercial supply of vaping goods is subject to strict Australian regulatory requirements. The TGA states that businesses involved in supplying and distributing therapeutic vaping goods must comply with the relevant regulatory framework.
For this reason, a large order should not simply be treated as a larger version of an ordinary consumer purchase.
Businesses and resellers should verify that they are eligible to receive the products and that the proposed supply arrangement is lawful before placing an order.
Why We Take Compliance Seriously
Australian vaping regulations are designed to control the supply chain and protect public health.
We therefore encourage customers to understand the rules that apply to them before purchasing or using any vaping product.
We do not encourage customers to bypass pharmacy requirements, prescription requirements, age restrictions, state or territory laws, or restrictions on where vaping is permitted.
Being informed is part of being a responsible customer.
A Final Word for Australian Customers
Vaping in Australia has not simply disappeared—it has moved into a much more tightly controlled regulatory environment.
The important question is not simply:
“Is vaping banned?”
The better question is:
“Is this product being supplied and used through a lawful pathway?”
For eligible adults, therapeutic vaping products may be accessible through participating pharmacies under the applicable rules. Some products and circumstances require prescriptions, while other supply pathways are restricted. State and territory laws can also add requirements.
Before purchasing, always check the current Australian and local requirements.
Choose lawful supply.
Understand your responsibilities.
Use products only where permitted.
And if you are unsure whether a product or supply arrangement is legal, speak with a participating pharmacy or qualified healthcare professional before proceeding.
Shop and Vape Responsibly
Australia's vaping laws are designed around controlled, therapeutic access—not unrestricted retail sales.
For that reason, customers should always verify their eligibility and use the appropriate pharmacy pathway.
We support responsible, lawful access and do not encourage anyone to bypass Australian vaping regulations.
